General Terms and Conditions (GTC) - Purajoya

1. Scope
These General Terms and Conditions (GTC) apply to all orders for products and the use of jewelry services via the Purajoya online store worldwide.
2. Payment terms
The available payment methods are displayed in the online shop. Purajoya reserves the right to exclude certain payment methods in individual cases.
2.1 Stripe
Payment processing is handled by Stripe. All data is transmitted using SSL encryption. Depending on the method selected with Stripe (e.g. credit card), the account will be charged either directly upon ordering or upon confirmation of shipment.
2.2 PayPal
Payments can be processed via a PayPal account. Use of this service is free of charge for the buyer.
2.3 Ecoo Payment Gateway
We accept payments via the Ecoo Payment Gateway. Transactions are processed in accordance with Ecoo's terms and conditions (www.ecooin.ch). Your account will be debited at the time of confirmation in the gateway.
2.4 Prepayment such as bank transfer & Twint
If you choose to pay in advance by bank transfer or Twint, we will only deliver the goods after the full invoice amount has been credited to our account.
2.4 Special conditions for jewelry services
The following procedure applies to services (repairs, platings, new products, etc.):
- Cost estimation: After receiving your request, we will provide you with a non-binding price range.
- Order placement: By sending us your jewelry or confirming our estimate, you are placing your order.
- Billing: Once the work has been completed, we will calculate the final amount based on the actual material consumption and time spent.
- Payment & Shipping: The customer will be informed when the order is complete (by email or WhatsApp). The return shipment or collection will only take place after the final amount has been paid in full.
- Right of retention: Purajoya retains a right of retention on the items handed over by the customer for processing to secure all current and future claims arising from the order. We are entitled to refuse to return the jewelry until all outstanding invoices have been paid.
2.6 Disclaimer for jewelry services (especially costume jewelry)
When working on jewelry provided by customers (repairs, gold plating, coatings), Purajoya accepts no liability for unforeseeable reactions of the material.
- Material properties: Particularly in the case of costume jewelry or jewelry of unknown composition, chemical reactions in the electroplating bath or when exposed to heat can lead to discoloration, blistering, or material changes.
- Stones and adhesives: We expressly point out that glued stones or pearls may come loose during the cleaning process or in the coating bath. No liability is accepted for lost or damaged stones that are not mechanically set.
- Feasibility: If, during of after processing, it becomes apparent that an order (e.g., gold plating) cannot be carried out with the desired result due to the nature of the material, we will inform the customer. The processing costs incurred up to this point (cleaning, testing) may be invoiced.
- Maximum liability limit: Liability for damage to the jewelry submitted is limited to the amount of the service order, to the extent permitted by law, unless the damage was caused by gross negligence on our part.
3. Order and contract conclusion
The contract is concluded when we accept your order by delivering the goods or by notifying you of the delivery. In the case of jewelry services, the contract is concluded when we confirm that we have started work.
4. Delivery terms and transfer of risk
4.1. Shipping
We ship goods in stock as quickly as possible. Express deliveries are charged at a flat rate of CHF 20 (subject to change depending on destination).
In the event that the ordered goods are unavailable, we reserve the right not to deliver. In this case, we will inform you immediately and refund any payments already received without delay.
4.2. Transfer of benefits and risks
According to the Swiss Code of Obligations (Art. 185 CO), the benefits and risks are transferred to the customer as soon as the shipment has been handed over to the post office or a courier service. Purajoya is not liable for transport damage or loss of packages by the shipping service provider.
5. Right of withdrawal & exchange
You have 14 days to inspect the goods. Purajoya will only accept returns of unworn items in their original packaging. You are responsible for the cost of returning the goods.
Exclusion: All jewelry services (repairs, gold plating, custom-made items) are excluded from the right of withdrawal, as these have been individually manufactured or processed according to customer specifications.
6. Warranty and guarantee
6.1 New purchase of jewelry
We offer a 6-month warranty on jewelry (excluding loss, damage caused by the customer, natural wear and tear, or clearance items). The invoice serves as proof of warranty.
6.2 Warranty for jewelry services (repairs and platings)
A limited warranty applies to services performed on existing jewelry:
- Durability of coatings: Since the durability of gold or silver plating depends largely on the material properties of the base material and how the customer wears the item, no guarantee can be given for the durability of the coating.
- Repairs: We guarantee that repairs will be carried out professionally. The warranty is limited exclusively to the work carried out by us (e.g., a new solder joint).
- Exclusion: No warranty is provided for damage attributable to the defective basic substance of the jewelry submitted (e.g., brittle material, hidden cracks, inferior alloys).
- Notice of defects: Obvious defects in the service must be reported to us in writing within 5 business days of receiving the jewelry.
7. Retention of title
The goods remain the property of Gur & Partner GmbH until full payment has been received.
8. Applicable law and place of jurisdiction
All contracts are governed exclusively by Swiss law. The exclusive place of jurisdiction for all disputes is the registered office of Gur & Partner GmbH.
In the event of any discrepancy between the German and English versions of these Terms and Conditions, the German version shall prevail and be legally binding.
